Why is the OMA requesting release of your Personal Tax Info?

Read Letter from Lax O'Sullivan Lisus Gottlieb LLP to the Privacy Commissioner of Canada 

Issue:   

  1. OMA has asked Canada Revenue Agency (CRA) for personal physician and professional corporation tax data by specialty saying they have “implied consent” from doctors, but they did not actually ask their members.  

  2. CRA and Statscan (the federal agency providing the data) have been misled to believe Ontario Physicians support this data mining of personal tax info.

  3. Doctors are largely unaware of this tax data request and how it will be used to change relativity impacts by specialty.

  4. OMA has used outside consultants to justify “implied consent” argument to support its request to CRA

  5. Why were OMA members not consulted about this invasion of physician privacy?

  6. Despite solemn promises, OMA’s transparency and open process promise has been abandoned

  7.  Can you trust the OMA with your private and personal tax information?

Reasons Why Doctors Should be Concerned

  1. OMA says tax data request will have no impact on doctors, but it has no control whatsoever over the CRA launching tax audits in the future.

  2. Why is your personal tax information being made available to the OMA?  Isn’t this private information?

  3. No means to audit accuracy of data received or independent ability for physicians to control how it will be used by the OMA.

  4. Previous OMA attempts to obtain Revenue Canada tax data were abandoned due to unreliability.

  5. CRA data could be discoverable if used in the arbitration process meaning it could be in the public domain for others to view.

  6. This has the potential to harm all physicians in the upcoming negotiations.

What Can You Do?

  1. Notify the OMA President via the automated message that you do not consent to the release or use of your personal tax data.

  2. Support the efforts to advise the federal Privacy Commissioner and federal privacy directors at the CRA and Statscan that you have not provided your consent.

  3. Advise your District Council representatives and delegates to support and pass a motion at the November 28-29thOMA Council to stop this invasion of your privacy.
